For years, redevelopment in Maharashtra has been a story of hope and heartburn. Hope for better homes, and heartburn due to delays, disputes and lack of transparency. The Maharashtra government’s revised redevelopment framework – which supersedes the older 2009 and 2019 guidelines – is a welcome and much-needed reset.
As someone who has watched hundreds of societies in Thane and Mumbai struggle with this process, I believe these new rules, if implemented in letter and spirit, will bring much-needed discipline and dignity to redevelopment.
Let me break down what has changed and what it means for you.
1. The 51% Consent Rule: Clarity Finally
One of the biggest confusions was about member consent. The revised framework now clearly states that a minimum of 51% member consent of the total membership strength is required to pass a redevelopment resolution.
This is a practical and democratic threshold. It prevents a small minority from holding an entire society hostage, while also ensuring that a majority genuinely wants redevelopment. More importantly, developer selection meetings must now be held in the presence of a registrar-authorized officer. This single step will eliminate a lot of allegations of bias and arm-twisting.
1. No More Secret Deals: Tender and Selection Process Strengthened
This is the heart of the reform. Every society must now:
For years, I have advised societies: never select a developer without comparative analysis. A PMC report is your technical and financial mirror. Making it mandatory within a time-bound manner will professionalize the entire process and give members a real choice, not just a name pushed by a few office bearers.
1. Time is Money: Strict Timelines Introduced
This is the most powerful change. Delays are the biggest fear for any society member who vacates his home.
The new rules mandate:
This accountability is crucial. It will filter out non-serious players who acquire projects and then sit on them. For genuine developers like us in CREDAI MCHI Thane, timelines are a commitment, not a convenience.
1. Security of Your Home: PAAA Made Mandatory
The framework makes it compulsory to execute and register Permanent Alternative Accommodation Agreements (PAAA) for individual members before shifting or within three months of DA registration.
I cannot stress enough how important this is. Your existing flat is your only security until you get your new home. A registered PAAA protects your ownership, your carpet area, and your rights. No society should allow its members to vacate without this document.
1. Transparency is Now a Right
Perhaps the most empowering clause: Members have the right to inspect all redevelopment records – including meeting minutes, video recordings, and tender documents – free of cost.
Sunlight is the best disinfectant. When every record is open for inspection, disputes reduce automatically.
My Final Take for Thane, Mumbai and the MMR:
Thane has over 5,000 housing societies that are 30+ years old and eligible for redevelopment. These revised rules are not anti-developer or anti-society; they are pro-transparency.
My advice to societies is simple:
Do not rush. Follow the 51% process diligently, insist on newspaper advertisements, appoint a reputed PMC, and never vacate without a registered PAAA and a bank guarantee.
And my advice to my fellow developers is equally clear: If we want trust, we must embrace timelines and transparency.
At CREDAI MCHI Thane, we welcome this framework and are committed to working with the state government to ensure redevelopment in Thane becomes a model for Maharashtra – time-bound, transparent and truly people-centric.
